  2. WHEN DOES THIS PRIVACY POLICY APPLY?

    This Privacy Policy describes our practices in connection with the personal information collected about individuals interacting with us and our products and services, including our websites, social media pages and promotional sites that we control or which link to this Privacy Policy(each a “Site,” collectively the “Sites”).

    This Privacy Policy does not apply to personal information we obtain in our capacity as an employer. Please see our internal employee privacy policy or separate fair processing notice, which can be found when you apply for a job. This Privacy Policy does not apply to third party sites including social media sites or Linked Sites.

  3. COLLECTION AND USE OF PERSONAL INFORMATION

    Molson Coors collects personal information relating to you in a variety of ways depending on how you interact with us.

      Billing and shipping information (e.g., billing information such as credit card information, which is collected directly by our payment processor and shipping addresses and contact information).

      We use your information to perform our contract to fulfill your order and process your transactions/payments.

      Username and passwords used to access Sites. Verification or tokens through social media platforms.

      We have a legitimate interest in administering your account and providing account related functionalities. Accounts can be used for easy checkout and to save your preferences and transaction history.
      Interact with us on social media Social media information (e.g., profile name , profile image, and other images that you make available such as user-generated content).

      We have a legitimate interest providing customers with a means for interacting with us on social media.

      Government identification numbers (which may include, if you are resident in the US, Social Security Number (in limited circumstances, for example if you win a sweepstakes or receive compensation that must be reported on government tax forms)).

      We have a legitimate interest in operating the sweepstakes, contests, and special offers, including notifying you if you are selected. In some contexts we are also required by law or regulation to collect personal information about those that enter into our sweepstakes, and use that personal information in order to comply with those laws and regulations.
      Complete a survey or voluntarily provide personal information about yourself

      Preferences, shopping habits, and other lifestyle information, including product wish lists, order history, marketing preferences, and cell phone carrier.

      We have a legitimate interest in understanding our users and providing tailored services.

      We have a legitimate interest in understanding how you interact with our website to better improve it, and to understand your preferences and interests in order to select offerings that you might find most useful.

      Interact with our Site, emails, and/or online advertisements

      Where we collect personal information through the deployment of cookies and other similar technologies on our Site in order to better understanding our users and providing tailored services, we will rely on your consent to do so or you may opt-out of such use depending on your jurisdiction.

      We will rely on your consent where we use personal information to understand how you interact with our website to better improve it, and to understand your preferences and interests in order to select offerings that you might find most useful.

      We have a legitimate interest in monitoring our networks and the visitors to our Sites. We also have a legitimate interest in detecting and preventing fraud.


      Although the above chart describes examples of personal information we collect and our primary purpose in collecting such personal information, in many situations we have more than one legitimate purpose. For example, if you complete an online order, we collect your payment (directly through our payment processor) and shipping information to perform our contract with you (e.g., to process and fulfill your order), but we also collect your personal information because we have a legitimate interest in maintaining your personal information after your transaction is complete so that we can quickly and easily respond to any questions about your order. As a result, our collection and processing of your personal information is based in different contexts upon: (i) your consent (e.g., for marketing you have opted-in to receive, where required), (ii) the performance of our contract with you (e.g., to provide you with products and services you have requested); (iii) compliance with legal obligations (e.g., where we are required to disclose information to a court or tax authority); and/or (iv) our legitimate interests in conducting our business.

      To the extent that any information is considered “personal information” by local law, we treat this information as such and ensure that our handling of this personal information complies with all applicable data privacy and protection laws. To the extent permitted by applicable law, any information you provide to us directly may be combined with other information that you provide to us through other channels, that is publicly available, or that we may otherwise obtain, including from third parties.
       

    2. How We May Collect Personal Information: Molson Coors collects personal information from various sources, including, for example the following:
      • From You (e.g., name, address, email, phone number, date of birth, and your preferred means of communication when you voluntarily provide it);
      • Our Sites and Applications (e.g., when you purchase a product online );
      • Offline (e.g., customer service inquiries, tours, sweepstakes);
      • Online tracking technologies, including cross-device tracking (e.g., service file logs, IP address, cookies, tags, pixels, clear pixels, gifs, bugs, beacons, and other similar technologies, some of which may enable Molson Coors or our service providers to identify you and collect personal information about you across devices and Sites);
      • Mobile usage (i.e., personal information learned from our mobile application, such as your device’s latitude and longitude or your device’s location capabilities (e.g., GPS, Wi-Fi, Bluetooth signal, beacons, LED light chips or other similar technologies)) and 3rd party mobile pay applications or services;
      • Through your browser or device (e.g., certain personal information, including your device type, operating system name and version, IP address, Media Access Control (“MAC”) address, language, Internet browser type and version, and service provider);
      • Through website analytics and advertising features (e.g., Adobe Analytics, Google Analytics, Google Analytics Demographics, Interest Reporting, Adobe Flash technologies including but not limited to Adobe Flash Local Stored Objects, Quantcast, in each case as described in more detail in the “Tracking Technologies” section below); and
      • Other Sources (e.g., public databases, third party partners, social media platforms, from people with whom you are connected on social media platforms, and public forums).
  4. TRACKING TECHNOLOGIES

    1. Cookies and Tracking Technologies. Molson Coors utilizes “cookies”, “tags”, “pixels”, “clear gifs” and other similar tracking technologies on our Sites. A cookie is a text file that is placed on your computer or other mobile device when you access the Sites or the Internet. These technologies allow us to collect information about your interaction with our Sites and advertisements. Examples of such information may include, but are not limited to: demographic information, browser type, IP address, pages viewed, activity conducted, and timing of your visit.

      Different types of cookies may be used for different purposes on our Sites. These are known as: required/strictly necessary cookies, functional cookies, and advertising cookies. Some cookies may be provided by an external third party to provide additional functionality to our Sites, and these are included below. You may at any time change your preferences for certain tracking mechanisms. However, disabling such cookies may prevent you from using certain features or taking full advantage of all our offerings on our Sites.

      • Required/Strictly Necessary Cookies

        These cookies are necessary to enable the basic features of our Sites to function, such as providing secure log-in or remembering how far you are through an order. If you do not agree to the Required Cookies, then you will not be able to use the Sites.

      • Functional Cookies

        These cookies allow us to analyze your use of our Sites to evaluate and improve our performance. They may also be used to provide a better customer experience on our Sites. For example, remembering your log-in details, saving what is in your shopping cart, or providing us information about how our Sites are used.

      • Advertising cookies

      Molson Coors, our trusted service vendors/providers, and permitted third parties may also advertise our products on third-party websites.     2. Cookies on Your Browser. Subject to applicable privacy laws, we will place cookies and other personal information when you visit our Sites. We currently participate in third-party ad networks and use third-party cookies as discussed above to track your visits across websites.

      Additionally, you may at any time change certain tracking mechanisms through your browser settings. However, disabling such features may prevent you from using certain features or taking full advantage of all our offerings on our Sites. Please refer to your browser Help instructions to learn more about cookies and other tracking devices and how to manage their use. If you use another computer or change browsers, you will need to repeat the process of refusing or deleting cookies.     3. Ad Tracking. Certain devices may allow you to Limit Ad Tracking. Please refer to the settings on your computer or device for information on how to disable Ad Tracking. You can also opt-out of Ad Tracking as described below in Choices and Opt In/Out.
       

    4. Do Not Track Requests. While some browsers have a “do not track” feature, we do not currently recognize browser based “do not track” requests.
       

  5. SHARING YOUR PERSONAL INFORMATION/DISCLOSURE TO THIRD-PARTIES

    At times, Molson Coors may make certain personal information available to third parties and within our family of companies/brands. In addition to the specific situations described elsewhere in this Privacy Policy, we disclose personal information in the following situations as permitted by applicable law.
     

    • Affiliates. We share personal information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies and brands under common control).
    • Marketing Partners. We share personal information with vendors/providers that help us to evaluate and improve our marketing and promotional efforts, content, products and services, to better understand customer interests and preferences, to provide you relevant information, and to conduct joint marketing programs.
    • Service Vendors/Providers. We share personal information with service vendors/providers that help us with certain business activities, including but not limited to fulfilling and shipping your order, assisting us in Site operations, administer promotions, providing customer service, and delivering email communications.
    • Corporate Change. We may share personal information in connection with a corporate change including a merger, acquisition, or sale of assets, including during the planning and negotiation stages.
    • Third-party Partners. We may offer contests, sweepstakes, or other promotions with third party partners. If you decide to enter a contest, sweepstakes, or promotion that is sponsored by a third party, the personal information that you provide will be shared with us and them. Some jurisdictions require the sharing of personal information related to prizes and awards. Their use of your personal information is not governed by this Privacy Policy. We also share personal information with other third-party partners with whom we may enter into a relationship (e.g., sports alliances). Depending on the purposes for this sharing, Molson Coors may provide you with the option of whether this personal information may be shared prior to sharing with such a partner. The subsequent use of the personal information by the third-party partner will be governed by their own privacy practices and policies.
    • Public. Some of our Sites permit you to engage with or post on our social media pages and blogs, and other similar platforms. When you post on social networking platforms or other public platforms, the personal information that you share is visible to other users and can be read, collected, or used by other users. For example, if you list your name, age, and address on a social media site, this personal information is public. Please be aware that the privacy policy of the social networking site will apply to any content you post on or provide to that Site.
    • Certain Other Disclosures with Your Consent. We may ask if you would like us to share your personal information with other third parties who are not described elsewhere in this Privacy Policy with your prior formal consent to do so.
    • Certain Other Disclosures Without Your Consent. We may disclose personal information as required by law, such as in conjunction with a government inquiry or to comply with a subpoena, warrant, court order, or similar legal process. We may also share your personal information when we believe in good faith that disclosure is necessary to protect our rights, to defend against a legal claim, to protect your safety or the safety of us or others, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, or a violation of our policies.
       
  6. CHOICES AND OPT IN/OUT

    1. Emails. We may use your email address to send emails, newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties – at all times in accordance with your preferences. You can stop receiving promotional emails by following the unsubscribe instructions included in emails you receive from us or by contacting us using the details below.
       
    2. Mobile Marketing (SMS and MMS) Updates. We may send you text messages relating to our brands, promotions, and other legitimate purposes – at all times in accordance with your preferences. If you consent to join a mobile marketing list or participate in any text message program with us, there are typically message and data costs associated with receiving SMS (text) or MMS (multimedia) messages. These will vary based on your wireless carrier and plan. Check with your mobile carrier to determine what charges may apply. If you would like to stop receiving messages from us on your mobile device, reply to the message with “STOP” (or other message as instructed). You may also contact your mobile carrier for additional information on receiving or stopping mobile messages.
       
    3. Location Services. If you have previously enabled location sharing on your computer or mobile device, you may be able to opt out from further sharing by changing the settings on your computer or mobile device or by uninstalling the Application. We will not use any precise location data without your prior consent, which may be obtained directly by us or through our service providers or media partners.
       
    4. Push Notifications. If you wish to disable push notifications on your mobile device, refer to Settings on your mobile device.
       
    5. Third Party Analytics.
    6. Interest Based Advertising Opt-Out: Users can opt out of targeted advertising via the Digital Advertising Alliance’s (“DAA”) opt-out page and the Networking Advertising Initiatives’ (“NAI”) opt-out page at http://www.aboutads.info/choices/ and http://www.networkadvertising.org/choices/, respectively.     Please be aware that, despite our reasonable efforts to protect your personal information, no security measures are perfect or impenetrable. In the event that we are required by law to inform you of a breach to your personal information, we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

    We will store your personal information for as long as is reasonably necessary for the purposes for which it was collected, as explained in this Privacy Policy. In some circumstances, we may store your personal information for longer periods of time, for instance, where we are required to do so in accordance with legal, regulatory, tax, or accounting requirements.
     

  8. THIRD-PARTY APPLICATIONS/WEBSITES

    1. Social Networks/Online Communities

      On certain Sites, we may enable you to access online communities for sharing information such as messages, photos, and videos. We may also enable you to post content from some Sites to your profile on other social networks. We cannot control any policies or terms of such third-party social networks. For example, sharing such information with a social media site may require us to implement cookies and/or APIs in order to facilitate the communication between our Sites and the social media site. That information, shared through cookies and/or APIs, then becomes subject to that third party site’s privacy policy. As a result, we cannot be responsible for any use of your information or content by a third-party social network, which you use at your own risk.

      Our Sites may contain links to third-party websites or applications not controlled by Molson Coors or covered by this Privacy Policy. If you submit information to any of those websites or applications, your information is governed by their privacy policies. We have no control or authority over third-party sites and are not responsible for any information that you may submit on that site.
       

    3. Widgets and Interactive Applications

      Our Sites may include interactive programs that provide specific services from another company, such as “liking” or sharing content, often referred to as widgets. You may have the opportunity to submit information, such as your email or phone number for collection through a widget. A widget may also use cookies and/or collect usage data. Information collected by a widget is governed by the privacy policy of the company that created it.

    3. Exercising Your Rights. If you would like to exercise any of the rights described above, please submit a request using the contact details in the “Privacy Inquiries” section above. Please note we will request proof of your identity, and verify such identity in order to protect your personal information and ensure compliance with all applicable regulations and policies. In some cases, we may limit or deny requests where permitted or required by law. For example, except where disclosure is required by law, we may decide not to grant access or make revisions where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in any given case, or when the rights of others would be violated by granting the access. Additionally, we may deny a request if we are unable to adequately verify your identity. We reserve the right to charge a fee where permitted by law, including for example, if your request is manifestly excessive or unfounded. We will respond to your requests within the applicable timeframes and consistent with applicable regulations.

       
    4. International Transfers for UK and EU Residents You should be aware that Molson Coors is headquartered in the United States with corporate offices abroad. Your personal information may be transferred to and stored in the United States for processing. Additionally, any personal information that you provide to or that is collected by or on behalf of Molson Coors may be transferred or accessed by entities around the world consistent with the practices described within this Privacy Policy. The privacy laws in these countries may be less stringent than the laws in your country of residence. In relation to both internal transfers and the use of affiliates, service providers or suppliers, for personal information that is transferred outside of the UK and the European Economic Area ("EEA"), we rely on adequate measures such as the EU Commission-approved Standard Contractual Clauses, which give personal data the same protection it has in the UK and the EEA.   12. INFORMATION FOR CALIFORNIA RESIDENTS

    1. Your Privacy Rights Under the California Shine the Light Law. Under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us certain personal information are entitled to request and obtain from us, free of charge, information about the personal information (if any) we have shared with third parties for their own direct marketing use. Such requests may be made once per calendar year for information about any relevant third-party sharing in the prior calendar year.     2. Rights of California Residents Subject to applicable law (including certain exceptions and qualifications), as a resident of California, you may have certain rights with respect to your information. These rights may include the following:
      • Right of deletion. To request deletion of their personal information that we have collected about them and to have such personal information deleted (without charge), subject to certain exceptions.
      • Right to know. With respect to the personal information we have collected about them in the prior 12 months, to require that we disclose the following to them (up to twice per year and subject to certain exemptions):
        • categories of personal information collected;
        • categories of sources of personal information;
        • categories of personal information about them we have disclosed for a business purpose or sold;
        • categories of third parties to whom we have sold or disclosed for a business purpose their personal information;
        • the business or commercial purposes for collecting or selling personal information; and
        • a copy of the specific pieces of personal information we have collected about them.
      • Do-not-sell (opt-out). To opt-out of our sale of their personal information. We do not sell personal information about California consumers.
      • Right to non-discrimination The right not to be subject to discriminatory treatment for exercising their rights under the CCPA.

Please note that depending on your request, we may request proof of your identity and verify such identity, in order to protect your personal information and ensure compliance with all applicable regulations and policies. We may conduct the verification process by email or phone and may ask you to provide personal information such as your name, contact information, and any additional relevant information based on your relationship with us.
